By accessing or using KeptSimple ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including school administrators, instructors, and any other users who access the platform.

2. Description of Service

KeptSimple is a software-as-a-service (SaaS) platform that enables educational institutions and training schools to manage class scheduling, student registrations, and related administrative functions.

3. Account Registration

To use the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service
  • Use the Service for any fraudulent purpose

5. Payment Terms

Certain features of the Service require payment. By using paid features, you agree to:

  • Pay all fees associated with your use of the Service
  • Provide accurate billing information
  • Authorize us to charge your payment method for applicable fees

The Service operates on a credit-based system for registrations. Credits are non-refundable except as required by law.

6. Your Data

You retain ownership of all data you submit to the Service ("Your Data"). By using the Service, you grant us a limited license to use Your Data solely to provide and improve the Service.

You are responsible for:

  • The accuracy and legality of Your Data
  • Obtaining necessary consents from individuals whose data you submit
  • Complying with applicable data protection laws
  • Maintaining your own backups of Your Data

7. Student Data

As a school administrator, you are the data controller for student information submitted through your account. You are responsible for:

  • Providing appropriate privacy notices to your students
  • Obtaining necessary consents for data collection
  • Responding to student data access or deletion requests
  • Complying with educational privacy laws (such as FERPA, if applicable)

8. Intellectual Property

The Service and its original content, features, and functionality are owned by KeptSimple and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

9. Third-Party Services

The Service may integrate with third-party services (such as payment processors). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEPTSIMPLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless KeptSimple and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You may request an export of Your Data within 30 days
  • We may delete Your Data after a reasonable retention period

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
